The House Voted 417 to 3 to Send AI Data Centers the Grid Bill. Anthropic Is Already Paying It.

In four days, a near-unanimous House vote, a governor and the Scottish government all asked the same question: who pays for the wires? Here is how that question ends up in the price of compute.

On September 17, the US House passed the Ratepayer Protection Act by 417 votes to 3. Almost nothing passes 417 to 3. The bill directs regulators to make large data centers cover the full cost of the grid upgrades they trigger. It applies to campuses drawing more than 100 megawatts, and it still needs the Senate.

## Four days, three governments

The same day, Maryland's governor said he would sign a statewide moratorium on new data centers if one reached his desk.

A day earlier, Scotland made environmental impact assessments mandatory for every new datacentre above 50 megawatts, ahead of a parliamentary vote on a moratorium of its own.

On September 19, an IMF paper for EU finance ministers put strain on electricity networks on its list of AI risks, next to a productivity gain of about 1 percent over five years.

In July we argued that the buildout's next constraint was neighbors. The neighbors now have legislators, and the question has changed. July's was "should this be built here?". September's is "who pays for the wires?". The second is far easier to vote for, because nobody has to oppose AI to support it. Hence 417 to 3.

## The industry's two answers

**Pay.** On September 16, Anthropic agreed to anchor Zerra DC's Western Downs Digital Park in Queensland, a 2.16 gigawatt campus valued at A$32 billion. One term stands out in the record: Anthropic covers the grid connection costs for its leased capacity. That is the principle of the House bill, signed voluntarily, in a contract, a day before the vote.

**Flex.** The same day, Emerald AI, Google and Nvidia launched the AI Energy Management Alliance with 18 launch partners. Its aim is performance-based standards that reward data centers for verifiable flexibility, meaning a campus that can ramp its power use up or down on demand. Emerald raised a $150 million Series A on that idea in August. The pitch to a utility is simple: a campus that backs off at peak needs fewer upgrades in the first place.

Both are ways of getting ahead of a bill that would otherwise be written for you.

## Who sits above the line

One hundred megawatts is a low bar. Two Anthropic leases in our tracker state a capacity: 350 megawatts with Lambda in Texas and 460 megawatts with Nscale in West Virginia. Each is several times the threshold. In practice the rule covers the whole frontier buildout.

The space below the line is the part to watch. Crusoe raised $3.9 billion this week, in part to build truckable modular units alongside its large campuses. We have no evidence that anyone is sizing sites to stay under a threshold. But when one jurisdiction draws a line at 100 megawatts and another at 50, projects that arrive at 95 and 45 would not be a surprise.

## The hedges

The House bill is not law. The Senate has not voted, and our record does not say how regulators would calculate "full cost". The Maryland statement was conditional on a bill that does not yet exist. The Scottish moratorium vote has not happened. And the Queensland record gives no dollar figure for the grid connection, so we cannot say how large this line item is. We can only say it now appears in a signed deal.

## What to do with this

First, if you are signing or pricing a compute contract above 100 megawatts, ask who carries the grid upgrade cost, and what happens if the allocation rule changes mid-term. Both Anthropic leases above run six years. A cost rule can easily arrive inside that window.

Second, watch flexibility become the bargaining chip. If even one large utility adopts the alliance's standards, "can your campus curtail on request?" becomes a standard question in interconnection talks, and the operators who can say yes get connected first. The terms will show up in the compute deals we track before they show up in anyone's earnings call.
